Cheatly Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of Cheatly — including the cheatly.io website, the Cheatly Chrome extension, the Cheatly desktop application, and the Cheatly mobile app (together, the "Service"), operated by Lumini Labs, LLC ("we", "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

Cheatly uses AI to answer questions visible on your screen or captured in a photo. AI-generated answers may be inaccurate or incomplete, and we make no guarantee about the correctness of any answer.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the consent of a parent or legal guardian.

4. Acceptable Use and Academic Integrity

• You are solely responsible for how you use the Service and for complying with all rules, policies, and honor codes that apply to you — including those of your school, university, employer, testing provider, or any other institution.
• Use of the Service in circumstances where it is prohibited (for example, during a proctored exam that forbids outside assistance) is at your own risk. We are not responsible for any academic, disciplinary, or other consequences resulting from your use of the Service.
• You may not use the Service for any unlawful purpose, to infringe the rights of others, or to attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.

5. Accounts

Some parts of the Service require an account. You are responsible for keeping your credentials confidential and for all activity under your account. We may suspend or terminate accounts that violate these Terms.

6. Subscriptions, Billing, and Refunds

• Paid features are offered as an auto-renewing subscription. Pricing is shown at the point of purchase.
• Subscriptions purchased on cheatly.io are billed through Stripe and renew automatically each billing period until cancelled. You can cancel anytime at cheatly.io/account.html; cancellation takes effect at the end of the current billing period.
• Subscriptions purchased in the mobile app are billed through your App Store account and are managed and cancelled through your device's subscription settings. App Store purchases are also subject to Apple's terms.
• Except where required by law, payments are non-refundable, and no refunds or credits are provided for partial billing periods.

7. Intellectual Property

The Service, including its software, design, and content (excluding content you submit), is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

8. User Content

You retain ownership of the screenshots, photos, and text you submit to the Service. You grant us a limited license to process that content solely to provide the Service (for example, forwarding it to our AI provider to generate an answer). 9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANSWERS WILL BE ACCURATE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or if we discontinue the Service. You may stop using the Service at any time. Sections that by their nature should survive termination (including Sections 7, 9, 10, and 12) will survive.

12. Governing Law

These Terms are governed by the laws of the United States and the state in which Lumini Labs, LLC is organized, without regard to conflict-of-law principles.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be reflected in the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
